Please read these Terms of Service carefully before using PhantomAI. By accessing or using our Service, you agree to be bound by these terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of PhantomAI, including its website at phantomai-x.vercel.app, mobile applications, APIs, and related services (collectively, the "Service").

By creating an account or using the Service in any way, you confirm that you are at least 13 years old (or 16 in the European Union), have read and understood these Terms, and agree to be legally bound by them. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

PhantomAI is an AI-powered conversational platform that provides:

  • Multi-model AI chat using large language models (GPT-OSS 120B, GPT-OSS 20B via Groq)
  • Real-time internet search and web content summarisation
  • Persistent conversation history and cross-device sync
  • Prompt library, system prompt customisation, and productivity tools
  • A credits system governing AI usage limits

The Service is provided on an "as is" basis. Features, models, and availability may change at any time.

3. AI-Generated Content Disclaimer

⚠️ Important: AI-generated responses are produced automatically and may be inaccurate, incomplete, outdated, biased, or factually incorrect. PhantomAI does not guarantee the accuracy, reliability, or completeness of any AI-generated content.

You acknowledge and agree that:

  • AI responses are for informational and productivity purposes only and do not constitute professional advice (legal, medical, financial, or otherwise).
  • You should independently verify any important information before acting on it, especially for decisions with significant consequences.
  • PhantomAI is not liable for any harm, loss, or damage resulting from your reliance on AI-generated content.
  • AI models may occasionally produce outputs that are offensive, inappropriate, or factually wrong despite our safeguards.

4. User Accounts

4.1 Registration

To access most features, you must create an account via our authentication provider (Clerk). You agree to provide accurate and complete information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Security

You are responsible for all activity under your account. Notify us immediately at phantomai2009@gmail.com if you suspect unauthorised access. We are not liable for losses arising from unauthorised use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or are inactive for extended periods. You may delete your account at any time from the Settings page.

5. Acceptable Use Policy

You agree not to use PhantomAI to:

  • Generate, distribute, or promote illegal content, including child sexual abuse material (CSAM).
  • Harass, threaten, defame, or abuse any individual or group.
  • Create misinformation, deepfakes, or deceptive content intended to mislead others.
  • Generate malware, phishing content, or tools to facilitate cyberattacks.
  • Violate intellectual property rights including copyright and trademarks.
  • Attempt to reverse-engineer, scrape, or systematically extract data from the Service.
  • Circumvent rate limits, access controls, or the credits system.
  • Impersonate any person, organisation, or entity.
  • Use the Service for any purpose that violates applicable laws or regulations.
  • Use automated bots or scripts to interact with the Service without authorisation.

Violations may result in immediate account termination and, where required, reporting to relevant authorities.

6. Credits System

Certain features consume "Phantom Credits". Every account receives the same free daily allowance of 150 credits. There are no account tiers, no subscriptions, and nothing to purchase. Unused credits do not roll over to the next day. The credit cost of each action is published on the pricing page, and allocations or limits may change with reasonable notice.

Because PhantomAI does not sell credits, subscriptions, or any other paid plan, no payment, billing, or refund terms currently apply. If paid options are introduced in future, these Terms will be updated before they take effect.

7. Intellectual Property

7.1 Our IP

All software, design, trademarks, logos, and content forming the PhantomAI Service (excluding user-submitted content and AI outputs) are the intellectual property of PhantomAI and its licensors. You may not copy, modify, distribute, or create derivative works without our written consent.

7.2 Your Content

You retain ownership of content you submit (prompts, files, messages). By submitting content, you grant PhantomAI a non-exclusive, worldwide, royalty-free licence to use, process, and store that content solely to provide the Service.

7.3 AI Outputs

AI-generated outputs are provided to you for personal and commercial use subject to the terms of the underlying model providers (Groq). We make no intellectual property claims over outputs generated in response to your prompts, but cannot guarantee that outputs are free from third-party IP claims.

8. Third-Party Services and Advertising

PhantomAI integrates with and displays content from third-party services. This includes:

  • Google AdSense: We display advertisements served by Google AdSense. These ads help fund the Service. Ad content is controlled by Google and its advertising partners, not by PhantomAI.
  • Google Analytics: We use Google Analytics to understand usage patterns.
  • Groq / Tavily: Your queries are processed by these third-party AI and search providers.
  • Clerk: Authentication is handled by Clerk.

PhantomAI is not responsible for the content, accuracy, or privacy practices of third-party services. Links to third-party sites do not constitute endorsement.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

To the maximum extent permitted by applicable law, PhantomAI shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of data, profits, revenue, or business opportunities.
  • Damages arising from reliance on AI-generated content.
  • Service interruptions, outages, or data loss.
  • Unauthorised access to your account or data.

Our total liability for any claim shall not exceed the greater of (a) the amount you paid for the Service in the 12 months preceding the claim, or (b) USD $50.

10. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

11. Changes to Terms

We may revise these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, sending an email notification. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration or the courts of the jurisdiction in which PhantomAI operates, as applicable.
